Terms of Service

These Terms of Service explain the general conditions that apply when you book, purchase, participate in, or use training, respirator fit testing, consulting, and other services we provide.

About These Terms

These Terms of Service apply to services we provide as StartSafe Training & Consulting, Inc., operating publicly as StartSafe.

They apply to individuals, employers, organizations, schools, contractors, and other customers who purchase, book, arrange, or use our services, including:

  • Public safety-training courses
  • Respirator fit-testing appointments
  • Private and group training
  • Health and safety consulting services
  • Other training or related services we offer
  • Our website and online booking systems where applicable

Acceptance of these Terms

You accept the applicable Terms when you complete a booking or purchase where the Terms are presented, accept a quotation or proposal that references them, confirm private or group training, or enter into another service agreement with us.

Applicable service information, pricing, cancellation terms, important course requirements, and other material booking conditions should be reviewed before completing a transaction.

Service-specific agreements

Certain services may also be governed by a quotation, proposal, scope of work, training confirmation, invoice, service agreement, or other written agreement.

If a specific written agreement contains terms that differ from these general Terms of Service, the more specific agreement will govern that particular service to the extent of the conflict.

Booking & Payment

Pricing

Unless otherwise stated, our prices are listed in Canadian dollars and applicable taxes, including HST, are additional.

Prices may change from time to time. A later price change will not affect a confirmed and fully paid booking unless otherwise agreed.

Private training, consulting services, custom projects, and other specialized work may be priced through a quotation or proposal. Additional work requested outside an agreed scope may result in additional charges.

Individual and public bookings

Payment may be required to secure or confirm public training registrations, respirator fit-testing appointments, and other individually booked services.

A booking is not considered fully secured until any required payment has been received unless we agree otherwise.

Corporate and private training

Private and corporate customers may be required to pay in advance, provide a deposit, or may be approved for invoicing.

Where a quotation, proposal, invoice, or other written agreement provides specific payment terms, those terms apply to that service.

Outstanding payments

Where an account remains unpaid, we may, where legally and operationally appropriate:

  • Withhold confirmation of a booking
  • Pause future services
  • Require payment before accepting additional bookings
  • Withhold certificates or documentation where doing so does not conflict with applicable statutory or regulatory requirements

Cancellations & Rescheduling

Customer cancellations, refunds, rescheduling, training credits, no-shows, late cancellations, and private-training cancellations are governed by our separate Cancellation, Rescheduling & Refund Policy.

Customers should review that policy before completing a booking.

If we must cancel or postpone training or an appointment, available refund, credit, or rescheduling options will also be handled under that policy.

Weather-related cancellations and scheduling decisions are governed by our separate Inclement Weather Policy.

Course Requirements & Participation

Customers and participants are responsible for reviewing all communicated course or appointment requirements before attending.

Depending on the service, requirements may include:

  • Previous training or course prerequisites
  • Proof of previous certification
  • Identification
  • Required PPE
  • Suitable clothing or footwear
  • Respirators or filters
  • Clean-shaven requirements for respirator fit testing
  • Equipment required for practical training
  • Other requirements identified before the service

Failure to meet a clearly communicated requirement may prevent a participant from completing the course, assessment, or fit test. This does not automatically create an entitlement to a refund.

Attendance and conduct

Participants are expected to:

  • Arrive on time
  • Attend all required portions of the course
  • Participate in required exercises and assessments
  • Follow instructor directions
  • Follow applicable safety requirements
  • Behave respectfully toward instructors and other participants
  • Avoid unsafe or disruptive conduct

We may refuse or end a participant's involvement where necessary to protect participant or instructor safety, other participants, course integrity, or applicable certification requirements.

Removal because of unsafe, abusive, disruptive, or inappropriate conduct does not automatically entitle the participant to a refund.

Late arrivals

We may refuse entry or require rescheduling when lateness prevents a participant from receiving required instructional time, completing required course components or assessments, meeting certification requirements, or completing an appointment within the allocated time.

Refund or credit eligibility for late arrivals is governed by the Cancellation, Rescheduling & Refund Policy.

Certification & Training Records

Registration or payment for one of our courses does not automatically guarantee certification.

Successful completion may require a participant to:

  • Attend the required instructional time
  • Participate in required activities
  • Demonstrate required knowledge
  • Successfully complete practical evaluations
  • Successfully complete written evaluations
  • Meet applicable prerequisites
  • Meet other program-specific requirements

A participant who does not successfully complete required course components is not automatically entitled to a refund solely because certification was not issued.

Records and certificates

We may create and retain training, testing, and certification records for purposes including:

  • Service delivery
  • Record keeping
  • Regulatory requirements
  • Certification verification
  • Customer support
  • Replacement documentation
  • Business administration

Customers and participants are responsible for providing accurate registration information for certificates and other records.

Personal information contained in our records is handled in accordance with our Privacy Policy.

Employer & Customer Responsibilities

Where an employer or organization arranges training for workers, that organization remains responsible for its own workplace health and safety obligations.

Our training or consulting does not transfer the legal responsibilities of an employer, constructor, supervisor, worker, owner, or other workplace party.

Customers remain responsible for matters including:

  • Workplace-specific hazards
  • Site-specific training
  • Worker supervision
  • Equipment condition
  • Safe operating procedures
  • Required PPE
  • Competency requirements
  • Regulatory compliance
  • Other duties imposed on workplace parties

Participants also remain responsible for following applicable legislation, employer procedures, manufacturer instructions, site-specific rules, safe work procedures, and appropriate supervisor direction.

Training provides knowledge and instruction. It does not replace proper workplace supervision, site-specific hazard controls, or the continuing responsibilities of workplace parties.

Information provided by customers

Customers are responsible for providing us with information that is accurate, complete, current, and relevant to the requested service.

We may rely on customer-provided information when preparing training, certificates, records, recommendations, documentation, and consulting deliverables.

We are not responsible for errors resulting directly from materially incorrect or incomplete information supplied by a customer where the error could not reasonably have been identified by us.

On-Site & Equipment Training

Practical equipment training

Training involving equipment such as Mobile Elevated Work Platforms, forklifts, or other powered equipment may require suitable equipment to be available for practical training.

Where equipment is supplied by the customer, the customer is responsible for ensuring that it:

  • Is appropriate for the training being delivered
  • Is in safe operating condition
  • Has required inspections and maintenance
  • Is available when scheduled
  • Has required manuals or documentation where applicable
  • Can be safely used at the training location

We may stop or postpone practical training where equipment or site conditions are unsafe or unsuitable.

On-site training

When we deliver training at a customer's workplace or another location, the customer is responsible for providing a reasonably suitable training environment.

Depending on the service, this may include:

  • Appropriate training space
  • Safe access to the site
  • Required equipment
  • A suitable practical-training area
  • Required PPE
  • Site orientation where necessary
  • Washroom access where reasonably required
  • Suitable environmental conditions
  • Cooperation from participants and site personnel

We may stop, postpone, or modify training if site conditions prevent the service from being delivered safely or appropriately.

Any related financial consequences will be addressed through the Cancellation, Rescheduling & Refund Policy or the applicable private-training agreement.

Respirator Fit Testing

Participants are responsible for following all preparation requirements communicated for their respirator fit test.

Depending on the appointment, these may include:

  • Meeting applicable clean-shaven requirements
  • Bringing the required respirator where applicable
  • Bringing compatible filters where required
  • Following communicated pre-test restrictions relating to eating, drinking, smoking, or gum
  • Providing accurate information required for the fit-test record

Passing a fit test for one respirator does not guarantee that every respirator model, style, or size will fit that participant.

Where applicable, fit-test certification applies only to the respirator or configuration identified in the participant's fit-test record.

Consulting Services

Our consulting services may include health and safety guidance, documentation, program development, safety-system support, site observations, recommendations, digital safety-system support, and other agreed services.

Project-specific responsibilities, deliverables, pricing, and scope should be established through the applicable proposal, quotation, scope of work, or other written agreement.

Unless specifically agreed and provided by an appropriately qualified professional, our consulting services are not:

  • Legal advice
  • Engineering advice
  • A guarantee of regulatory compliance
  • A transfer of the customer's statutory responsibilities
  • A substitute for appropriate workplace supervision

Customers remain responsible for implementing appropriate workplace controls and meeting their own legal and operational obligations.

Website & Intellectual Property

Website information

We make reasonable efforts to keep website information accurate and current. However, website content may occasionally contain typographical errors, outdated information, pricing errors, scheduling changes, or technical errors.

If an obvious error affects a transaction, we will contact the customer and work to resolve the issue reasonably rather than attempting to enforce an obviously incorrect price or term.

Our materials

Unless otherwise stated, we retain ownership or applicable rights to our original website content, training materials, course graphics, documents, templates, videos, images, branding, written materials, and consulting resources.

Our proprietary materials may not be reproduced, resold, published, distributed, uploaded, or commercially exploited without permission.

This restriction does not prevent a customer from using documents specifically created and supplied for that customer's internal workplace use where that use forms part of the purchased service.

Recording training

We may prohibit unauthorized audio or video recording, photography of proprietary course materials, screen recording, or reproduction of course content during training.

Acceptance of these Terms does not operate as permission for us to use identifiable photographs or recordings of a participant for marketing purposes. Appropriate permission will be obtained separately where required.

Third-party services

We may use third-party platforms for bookings, payments, forms, email, training administration, website functionality, digital safety systems, and other business services.

We are not responsible for unrelated third-party services or websites that operate outside our reasonable control.

Accessibility & Privacy

Accessibility and accommodation

We are committed to providing our services in an accessible manner.

Customers or participants who require an accommodation are encouraged to contact us as early as reasonably possible so that available options can be considered.

Accommodation does not automatically remove essential course, safety, competency, or certification requirements.

Accommodation requests are handled in accordance with our Accessibility & Accommodation Policy.

Privacy

Personal information collected through our website, booking systems, training registrations, fit testing, certification processes, customer communications, and consulting services is handled in accordance with our Privacy Policy.

Responsibility & Workplace Compliance

No guarantee of workplace compliance

Purchasing our training or consulting services does not automatically make a workplace compliant with occupational health and safety legislation.

Workplace compliance depends on many factors, including:

  • Employer actions
  • Workplace conditions
  • Supervision
  • Hazard controls
  • Equipment
  • Documentation
  • Worker behaviour
  • Ongoing implementation

We provide training and support services intended to assist customers with workplace health and safety. Customers remain responsible for their own legal obligations.

Limits of Our Responsibility

To the extent permitted by applicable law, we are not responsible for losses or issues resulting from matters outside our reasonable control, including:

  • Unsafe or unsuitable customer-provided equipment
  • Incorrect or incomplete information supplied by a customer
  • Customer-controlled site conditions
  • Third-party systems or services outside our reasonable control
  • Participant conduct
  • An employer's implementation or failure to implement training, recommendations, or workplace controls

Nothing in these Terms is intended to exclude or limit responsibility that cannot lawfully be excluded or limited.

Changes to Services or Terms

Changes to courses or services

We may make reasonable changes to instructors, course locations, scheduling, delivery arrangements, equipment, course materials, or administrative processes where necessary.

Changes will continue to respect applicable approval, regulatory, certification, and contractual requirements.

Material changes affecting a customer's booking will be communicated where reasonably possible.

Changes to these Terms

We may update these Terms of Service as our services, website systems, business practices, or legal requirements change.

The Effective Date and Last Updated date shown at the top of this page will be updated when appropriate.

Changes will generally apply prospectively rather than altering previously confirmed transactions unless legally permitted and, where necessary, agreed to by the affected parties.

Governing Law

These Terms of Service are governed by the applicable laws of Ontario, Canada.

Nothing in these Terms removes or limits customer rights that cannot legally be waived or restricted under applicable law.
